JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2019 Earlier vide order dated 12.9.2018 this application with respect to petitioner No.4, Sunil Manjhi, was dismissed as withdrawn as he was arrested during the pendency of this application.
Petitioner Nos. 1 to 3 and 5 seek bail in anticipation of their arrest in connection with Nardiganj P.S. Case No. 107 of 2018, registered for the offences punishable under Sections 341, 323, 325, 307, 379 and 34 of the Indian Penal Code. Allegation against the petitioners is that they have assaulted the husband of the informant, causing injuries. Submission of learned counsel for the petitioners is

Having heard both sides and in the facts and circumstances, let petitioner Nos. 1 to 3 and 5, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah, in connection with Nardiganj P.S.Case No. 107 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
