JUSTICE PURNENDU SINGH ORAL ORDER 22-07-2026 At the outset, learned counsel appearing on behalf of the petitioner seeks to delete Para-7 of the bail application and also don't want to press the bail application on the basis of Annexure P/2.

2. Permission is accorded.

3. Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

4. The petitioner seeks pre-arrest bail in connection with Alamganj P.S. Case No. 144 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

5. Allegation is of recovery of 25 litres of country made liquor from a tempo.

6. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.46844 of 2026(2) dt.22-07-2026 2/3 petitioner submitted that the petitioner is innocent and he has falsely been implicated in the case. He has no concern either with the seized liquor or trade of liquor in any manner. The petitioner had given his tempo to someone for some work and he had no knowledge that his tempo will be misused for carrying liquor. Nothing has been recovered from the possession of the petitioner. Petitioner has clean antecedent.

7. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

8. Having heard the rival submission made on behalf of the parties, as well as, having perused the allegation made in the F.I.R., the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Patna City in connection with Alamganj P.S. Case No. 144 of 2018, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.

9. The District Court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in Para-
