The petitioner is apprehending her arrest in connection with Dhanarua P.S. Case No. 80 of 2017 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation against the petitioner is of recovery of two country made pistols and eight live cartridges from his possession. It has been submitted on behalf of the petitioner that nothing has been recovered from his possession, rather recovery has been made from joint house of the petitioner and further the petitioner is aged 75 years and due to enmity other cases have been lodged against him and there is four days delay in lodging FIR.

Patna High Court Cr.Misc. No.36685 of 2017 (2) dt.18-08-2017 2/2 Heard learned APP also, who has opposed the prayer for anticipatory bail.

Having heard both sides and in the facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner.

Let petitioner surrender before the court below and pray for regular bail, which shall be considered on the basis of the facts as well as materials available on record, if possible, on the same day.

With the above observation, this application is dismissed.
