The petitioners seek bail in anticipation of their arrest in connection with Mahisi (Jalai) P. S. Case No. 95 of 2020, dated 11.06.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 354 (B), 379, 307,
Patna High Court CR. MISC. No.802 of 2021(2) dt.01-07-2021 2/3 504 and 506 of the Indian Penal Code.
On the orders of petitioner no. 1, the other accused persons including petitioner nos. 2 and 3 are said to have assaulted the members of the prosecution party. Three persons are said to have been injured in the occurrence but those injuries are stated to be simple, except for one on one of the victims, who has received that injury in the elbow but that is not attributable to anyone of the petitioners. There is a counter version of the occurrence also and from the side of the accused persons there are four injuries.
Regard being had to the afore-stated facts and absence of any explanation of the injuries on the side of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. at Saharsa in connection with Mahisi
Patna High Court CR. MISC. No.802 of 2021(2) dt.01-07-2021 3/3 (Jalai) P. S. Case No. 95 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
