====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in a case for the offence registered under Sections 341, 323, 354, 307, 504/34 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that on 15.03.2018 the informant's Bhabhi went towards west Pyain of village and in that course, petitioners started teasing her in course of attending nature of call and when his Bhabhi made protest and raised hulla, his brother Pappu Yadav and uncle Lakhan Yadav ran then petitioner no. 1 Ranjit Yadav made firing with his country made pistol which hit at the left side of chest of Pappu Yadav and petitioner no. 2 Vimal Yadav also made firing with

Patna High Court Cr.Misc. No.58213 of 2018(3) dt.22-11-2018 2/3 his pistol which hit on the left thigh of Lakhan Yadav. On hearing sound of firing, villagers came there then petitioner no. 1 Ranjit Yadav and his companions Ramashray Yadav, Jito Yadav, Laxman Yadav armed with Lathi-Danda committed assault and when villagers assembled they fled away. It has been submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent. The petitioners have falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. There is allegation of causing injury by firearms. Injury report indicates that the injury has been caused by hard and blunt substance. Nature of injury is said to be simple. Allegations made in the FIR is not supported by medical examination report.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.,
