JUSTICE SANJAY PRIYA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend arrest in Bathnaha P.S. Case No. 141 of 2017 instituted for the offence under Sections-302, 307, 379 & other minor Sections of the Indian Penal Code and 27 of the Arms Act.
As per written report, these petitioners with other coaccused named in the FIR shot fire causing injury on head, leg and other parts of the body of father of the informant, on account of which, he subsequently, died.
The case diary has been received.
The learned APP has submitted that in the inquest report, mentioned in para-4 of the case diary and the postmortem report, the doctor has found fire-arm injury on head, leg and other parts of body
Patna High Court Cr.Misc. No.34016 of 2017 (3) dt.21-09-2017 and on account of those injuries, the deceased died. In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.
The petitioner is directed to surrender in the court below within four weeks from today and seek regular bail which will be considered by the court below on its own merit without being prejudiced by this order.
