The petitioner apprehends arrest in connection with Sarmera P.S. Case No. 118 of 2016 registered under Sections 420, 409 and 120B of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that after preparing the list and proper verification, the sanctioned amounts have been distributed to the beneficiaries, which would appear from Annexures 2 and 2/1. It is also submitted that after enquiry, no irregularity has been found (Annexure-3). Further submission is that the sanctioning authority and similarly situated co-accused have already been allowed bail by different Benches of this Court vide Cr. Misc. No. 2487 of
Patna High Court Cr.Misc. No.36307 of 2017 (2) dt.19-08-2017 2/2 2017 and Cr. Misc. No. 18065 of 2017.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Nalanda in connection with Sarmera P.S. Case No. 118 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shailendra/- U T
