Petitioner apprehends his arrest in Korma P.S. Case No.57 of 2016 instituted for the offence under Section(s) 304B/34 Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act pending in the Court of the Judicial Magistrate, 1st class, Sheikhpura.
From the written report, it appears that the deceased died in her Sasural within three months of her marriage. There is allegation that she was tortured for a motorcycle and twenty thousand rupees. She was not allowed to live properly due to non-fulfillment of the aforesaid demand. She was also denied food and confined in a room.
Petitioner is husband of the deceased.
Patna High Court Cr.Misc. No.38833 of 2017 (2) dt.30-08-2017 2/2 In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off by the Court below in accordance with law without being prejudiced by this order.
