Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Naubatpur P.S. Case No. 211 of 2019 registered for the offences punishable under Sections 341, 323, 354(A), 307, 504 read with Section 34 of the Indian Penal Code.

The prosecution case in nutshell is that the informant namely Shiv Kumar Sao given a written information to the officer in charge Naubatpur P.S. to the effect that his daughter's modesty was outraged by the accused persons when she was performing a task on the Dalan alone and when she raised alarm the informant came for her rescue and thereafter the accused persons attacked the informant with sword in order to kill the informant. The injury of the sword made by the accused persons on the informant caused injury on head and it is further alleged

Patna High Court CR. MISC. No.2314 of 2021(2) dt.12-03-2021 2/2 that the informant due to assault fell down and became unconscious thereafter it is alleged that the informant's son and daughter by sprinkling water made the informant conscious and brought him to the hospital.

Learned counsel for the petitioner submits that there is case and counter case between the parties. Earlier the petitioner has filed the case against the informant. Thereafter, the informant filed the present case. There is general and omnibus allegation against the petitioner and similarly situated coaccused has been granted bail by different Co-ordinate Bench of this Court.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 2nd, Danapur in connection with Naubatpur P.S. Case No. 211 of 2019.
