While informant Akhilesh Rai along with his wife were away from their house, his daughter, Rekha Kumari (victim) aged about 15 years was found missing from their house on 08.05.2014. During course of search, he came to know with regard to active connivance of the accused persons including the petitioner.

Annexure-3 is the statement recorded under Section 164 Cr.P.C. of the victim whereunder she has disclosed her age to be 15 years. However, from her statement it is apparent that she out of her own will left her house and married with the petitioner as well as consummated the same.

Petitioner happens to be under custody since

Accordingly, petitioner, Ranjeet Rai @ Ranjeet Kumar Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri S. Priya, Judicial Magistrate, 1st Class, Katihar in connection with Barari P.S. Case No.65/2014, GR No. 1288/2014.
