The petitioner apprehends his arrest in connection with Jakkanpur P.S. Case No. 280 of 2018 (Spl. POCSO) 126 of 2018 for the offence punishable under Sections 354 of the Indian Penal Code and Sections 8/12 of POCSO Act, 2012. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the victim girl in her statement recorded under Section 164 Cr.PC. has not disclosed anything about the petitioner. She has stated that the petitioner has not committed any over act with her. Moreover, father of the victim girl has also stated that petitioner has not committed any
Patna High Court CR. MISC. No.60989 of 2018(6) dt.19-06-2019 2/2 overt act with her daughter which is evident from paragraph 39 and 40 of the case diary. Hence, the petitioner may be granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-1 - cum- Special Judge (POCSO), Patna in connection with Jakkanpur P.S. Case No. 280 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) brajesh/- U T
