====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-09-2021 Heard Mr. Uday Shankar Singh, learned advocate for the petitioners and Mr. Syed Mojibur Rahman, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Dariyapur P. S. Case No. 265 of 2020, dated 06.08.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 302, 504 and 506 of the Indian Penal Code.

The accusation in the F.I.R. is that one person

Patna High Court CR. MISC. No.5108 of 2021(2) dt.17-09-2021 2/3 was killed whereas another was severely injured. The learned advocate for the petitioners has submitted that 35 persons have been named in the F.I.R. including the petitioners and 10 to 15 unnamed persons also are alleged to have committed the occurrence. Some of the accused persons have been specifically attributed with the weapon and the assault. So far as the petitioners are concerned, except for their being named in the F.I.R., there are no other accusation against them.

There is a counter version of the occurrence also and the implication of the petitioners in the present case is on account of land dispute.

The petitioners have no criminal antecedents. Regard being had to the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their

No.5108 of 2021(2) dt.17-09-2021 3/3 furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 13th , Saran at Chapra in connection with Dariyapur P. S. Case No. 265 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
