The report of learned Additional District Judge-VIcum-Special Judge, POCSO Act, Biharsharif, Nalanda dt. 25.7.2023 suggests that five witnesses have been examined out of nine charge-sheet witnesses and the trial is likely to be concluded within a period of four months.

In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the petition after some argument.

Permission is accorded.

Accordingly, the petition is dismissed as withdrawn. The learned trial court is directed to expedite and

Patna High Court CR. MISC. No.46924 of 2022(8) dt.04-09-2023 2/2 conclude the trial positively within the stipulated period of time (i.e. four months), failing which, the petitioner will be at liberty to renew his prayer for bail.

The concerned Superintendent of Police is directed to produce the remaining witnesses as and when required by the trial court below so that the trial may be concluded within stipulated time.
