JUSTICE SUDHIR SINGH ORAL ORDER 19-07-2019 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners seek bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 325, 302 of the Indian Penal Code.
Allegation is that the accused persons including the petitioners having entered into the house of the informant and assaulted the father of the informant, as a result of which informant's father succumbed to the injuries. It has been submitted on behalf of the petitioners that the petitioners are in custody since 6.5.2019. Charge sheet has
Patna High Court CR. MISC. No.44402 of 2019(2) dt.19-07-2019 2/2 been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made. No specific injury is attributed against the petitioners. The petitioners have falsely been implicated in the present case. Other co-accused have been granted bail vide Cr.Misc.No.26837 of 2019. It is further submitted that the petitioners may be released on bail after completion of six months in custody from 6.5.2019. On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail after completion of six months in custody from 6.5.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Jamhor P.S. case No.131 of 2018.
