JUSTICE BIRENDRA KUMAR ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 307, 504 and 506/34 of the Indian Penal Code. The petitioners allegedly caused injury at the head of the respective injured with iron rod.
Submission of the learned counsel for the petitioners is that there is case and counter case for land dispute. The injuries found were simple in nature.
Considering the fact that the petitioners had knowledge that their act might cause death, I am not inclined to
Patna High Court Cr.Misc. No.44809 of 2017 (2) dt.19-09-2017 2 /2 enlarge them on anticipatory bail in connection with Madanpur Police Station Case No. 129 of 2017 pending in the court of learned Chief Judicial Magistrate, Aurangabad (Bihar)/successor court.
Accordingly, prayer for bail is refused.
