The petitioner seeks bail in anticipation of his arrest in connection with Parbatta P. S. Case No.207 of 2020, instituted for the offences under Sections 147, 148, 149, 323, 324, 326, 307, 302, 354A, 427 of the Indian Penal Code. It is alleged in the F.I.R. that all the accused persons assaulted the deceased resulting in his death. The accusation of assault, it has been argued, is on somebody else. The petitioner has been made accused in this case because he happens to be a family member of the persons with whom the informant had fought. The petitioner had been residing in Delhi for a long time but has been made accused in
Patna High Court CR. MISC. No.1786 of 2021(2) dt.13-07-2021 2/2 this case without there being any specific accusation against him.
The petitioner can at best be said to be the member of the mob.
Regard being had to the facts afore-stated and the clean antecedents of the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Khagaria in connection with Parbatta P. S. Case No.207 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
