JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Bidupur P.S. Case No. 53 of 2014 registered under Sections 147, 148, 149, 323, 307 and 379 of the Indian Penal Code.

The accusation is that petitioner along with three others named in the F.I.R. came near the informant, where he was cutting the bamboo and tried to remove the same and began to hot talk when the informant made protest, the petitioner gave sickle blow at the head of the informant. Other accused also assaulted through the butt of the revolver at the head of the informant. Learned counsel for the petitioner submits that due to land dispute occurrence took place and regarding the same

Patna High Court Cr.Misc. No.46762 of 2014 (2) dt.04-02-2015 occurrence, petitioner has also lodged a case against the informant bearing SC/ST Hajipur P.S. Case No. 05 of 2014. It is further submitted that moreover injury as found on the person of the injured is of simple in nature and this petitioner is in custody since 30.09.2014.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 53 of 2014.
