The petitioner apprehends his arrest in Raxaul G.R.P. S. Case No. 08 of 2017 registered for the offences under Sections 467, 468, 471, 419, 420, 120B/34 of the Indian Penal Code. Allegedly, the petitioner being in collusion and conspiracy with Pankaj Kumar was working as contractor of vending at Raxaul Railway Station though the contract was stopped since 21.07.2016.
Submission is of false implication and that the petitioner was the manager of Pankaj Kumar and Pankaj Kumar was allotted contract of vending at Raxaul Railway Station and the petitioner was looking after his works, no offence as alleged is
Patna High Court Cr.Misc. No.44165 of 2017(2) dt.20-09-2017 2/2 made out. The contract work has already been stopped on 21.07.2016 itself and since then, no work of vending is going on at Raxaul Railway Station. The informant due to oblique motive has lodged this false case and as such the petitioner deserves sympathetic consideration.
Learned APP opposes the prayer of pre-arrest bail. In the facts and circumstances of the case, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judicial Magistrate, Railway, Bettiah in connection with Raxaul G.R.P.S. Case No. 08 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
