2. This appeal has been filed against order dated 29.05.2025 passed by learned ADJ 1st cum Special Judge, SC/ST Act, Bettiah (West Champaran) in a case registered under Sections 126(2), 115(3), 74, 303 and 3(5) of the B.N.S., 2023 and Section 3(i)(r)(s) of the SC/ST Act, whereby the prayer for anticipatory bail of appellants has been rejected.

3. Allegation against appellants is that they alongwith other co-accused persons assaulted informant and her family members, due to which, informant sustained grievous injury. It is further alleged that accused persons also abused informant by taking her caste name.

4. Learned counsel for the appellants submits that appellants have been falsely implicated in this case. Both parties are next door neighbours and due to land dispute, simple Maarpeet took place. Allegation of assault is general and omnibus.

5. Learned Spl. Public Prosecutor for the State vehemently opposes the appeal and submits that appellants are named in the F.I.R. with specific allegation that they alongwith one co-accused Lalu Yadav brutally assaulted informant and her family members and injury sustained by informant is grievous in nature. Besides this, appellants have got two criminal antecedent, out of which, one is of similar nature.

6. Considering the aforesaid facts and circumstances, I am not inclined to interfere with the order impugned. Accordingly, the appeal stands dismissed.
