The petitioner seeks pre-arrest bail in connection with Warisaliganj P.S. Case No.255 of 2018 registered under Sections 341, 323 and 489A/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there is no truth behind the allegation made in the first information report. As a matter of fact, the petitioner wants to keep his wife in the matrimonial home with full dignity and honour, but for one reason or the other she is not willing to live with the petitioner. Even when matter was sent to the mediation center, Nawada by the learned Sessions Judge for reconciliation,
Patna High Court Cr.Misc. No.60244 of 2018(4) dt.11-12-2018 2/2 she neither appeared in person nor through advocate in spite of two adjournments.
Learned counsel for the State and the informant vehemently opposed the application for grant of pre-arrest bail to the petitioner. They submitted that the petitioner regularly subjects the informant to cruelty for demand of dowry. Considering the nature of allegation and the submissions advanced at Bar, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate,-II, Nawada in connection with Warisaliganj P.S. Case No.255 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md. S/- U T
