The petitioner apprehends her arrest in connection with Beldour P.S. Case No.67 of 2019 registered under Sections 307/34 of the Indian Penal Code besides Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.
The accusation is that on 06.05.2019 at about 03.00 P.M., when the informant came out of his house, hot exchange of word was going on in between the elder brother of the informant and Sulo Sada in the way of the village, where Pabo Devi (petitioner), the mother of Sulo Sada, was also present. Thereafter, Sulo Sada fired through his country made pistol at the informant, which hit at the right shoulder of the informant,
Patna High Court CR. MISC. No.45380 of 2019(2) dt.24-07-2019 2/2 due to which the informant received injury. Thereafter, Sulo Sada fled away from there leaving his country made pistol. Learned counsel for the petitioner submits that the specific allegation of making firing at the informant is against Sulo Sada. The petitioner has falsely been implicated in this case. The petitioner, who is lady, has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Khagaria, in connection with Beldour P.S. Case No.67 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
