2. The petitioner is seeking regular bail in connection with Sitamarhi P.S. Case No. 246 of 2024 for the offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, while the informant was going to market for purchase necessary articles and reached near ring bandh, all of a sudden the named accused persons including the petitioner along with 3-4 unknown persons having armed with weapons surrounded him started to abuse in filthy words and consequently, the informant was assaulted, as a result of which, he sustained injury.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.54983 of 2024(2) dt.22-08-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the allegation against the petitioner is general and omnibus and the injuries are simple in nature. He has also submitted that the petitioner is a person of clean antecedent and is under custody since 14.04.2024.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the petitioner was also involved in the occurrence and the informant has suffered injuries.

Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 246 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
