1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Barari Police Station Case No. 20 of 2024, disclosing offences under Sections 341, 323, 307, 379, 354, 506, 504, 34 of the Indian Penal Code.

3. As per the First Information Report, on 11.01.2024, the informant went to the brick klin and demanded his back wages upon which the petitioners along with other accused persons assaulted the informant and his wife also snatched golden chain from the informant's wife and torn saaree and blouse etc.

4. Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in the present case due to dispute between the petitioner no. 1 and the informant. The petitioner no. 1 is the own brother of the informant. The

Patna High Court CR. MISC. No.49624 of 2024(2) dt.21-08-2024 2/2 allegation of assault is upon the co-accused Mithun Singh and the injury caused to the informant is simple in nature as would be evident from the impugned order.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that specific allegation of assault is upon co-accused Mithun Singh, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 1st, Katihar, in connection with Barari Police Station Case No. 20 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
