Patna High Court CWJC No.9920 of 2012(4) dt.13-02-2023 2/3 "1(i) for the issuance of a rule in the nature of writ of certiorari for quashing the proceeding initiated on the complaint filed by respondent no.9 with regard to appointment of chairperson of Ad hoc committee of Urdu Middle School, Lakhanpur in Block Tarapur, District-Munger before respondent no. 3 in as much as the matter of location of the concerned school is still pending before the respondent no. 10.

(ii) for the issuance of a rule in the nature of writ of Mandamus commanding the respondent authorities to appoint the petitioner as chairperson of Ad hoc committee of Urdu Middle School, Lakhanpur in Block Tarapur, District -Munger in as much as the aforesaid school falls in ward no. 6 and the petitioner is a member of Ward No. 6 and as per Section 5 of the Bihar Elementary School Education Committee Act 2011, (For short-The Act), the member of the ward in which the school falls would be the chairperson of the Ad hoc Committee."

2. It is informed by learned counsel for the respondents that the Ward member of the local area becomes the President/Chair-Person of the Committee.

3. Since the election of the concerned Panchayat has again taken place, the present writ petition has rendered infructuous.

4. Accordingly, the present petition is dismissed as infructuous.
