2. The petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 380/2023 lodge on 11.07.2023 under Section 302/201/120B/328 of the Indian Penal Code.
3. As per the prosecution case, F.I.R. has been lodged against two named accused persons including the present petitioner who has been shown as suspected accused to whom there is an allegation that he was having illicit relationship with the mother of the deceased and to hide this mother of the deceased has killed her daughter.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner is named in the F.I.R. but he has shown as suspected accused. The Nanad of the co-accused namely Poonam Devi is alleged to be the eye witness. He submits that the said Poonam Devi has made confession before

Learned counsel for the petitioner further submits that antecedent of the petitioner is clean and he is unnecessarily been made accused in the present case. Counsel submits that in the investigation it has come somewhere that there is enimical relationship between the family of the deceased and the petitioner. Counsel further submits that the criminal antecedent of the petitioner is clean and the petitioner is in custody since 19.02.2024.
5. Learned APP for the State opposes the prayer for bail and submits that from the F.I.R. it seems that the entire story of the crime is moving around the petitioner just to hide the illicit relationship between the alleged Poonam Devi and the petitioner.
6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. As such, the bail application of the petitioner is hereby rejected with liberty that he may renew his prayer for bail three months after framing of charge. (Dr. Anshuman, J) Sunnykr/- U
