JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Dhaka P. S. case no. 365/2016 registered under sections 363 and 366A of the IPC.

Petitioners are named in the first information report and admittedly, up till now, victim could not be recovered. The Superintendent of Police in his supervision note has directed the Investigating officer not to make the petitioners accused till recording the statement of victim under section 164 Cr.P.C. In the aforesaid circumstances, this anticipatory bail petition is disposed of with observation that till recording the statement of victim under section 164 Cr.P.C, no coercive steps

Patna High Court Cr.Misc. No.59456 of 2018(3) dt.14-12-2018 2/2 shall be taken against the petitioners in connection with the above stated Dhaka P. S. case no. 365/2016 pending in the court of S.D.J.M, Sikrahana at Dhaka District East Champaran. (Hemant Kumar Srivastava, J) s.hassan/- U T
