2. The petitioners have prayed for bail in connection with Sonhan P.S. Case No. 49 of 2025 registered for the offence punishable under Sections 87, 142, 143 of the B.N.S., 2023.

3. The case of the prosecution is that the minor daughter of the informant was missing from the house. It is

Patna High Court CR. MISC. No.45523 of 2025(3) dt.16-09-2025 2/3 alleged that the victim was on talking terms on mobile no. 8603688626, and the informant believes that the holder of this mobile number has kidnapped her.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this case. He also submits that during the course of investigation, the victim was recovered and she has given her statement recorded under Section 183 of the BNSS, wherein she has stated that as her mother scolded her, she went out of her house, and she was going to jump before a train then one Sunny rescued her and took her to her sister-in-law's place in Patna. She remained there for two days, and after that she was taken to Haryana by the sister-in-law of Sunny, and she was married to Mohan (petitioner no. 1). He also submits that there is no allegation against this petitioner no. 1 namely, Mohan @ Mohan Lal that he has kidnapped the minor daughter of the informant. The only allegation against petitioner no. 1 namely, Mohan @ Mohan Lal is that the victim was married with this petitioner.

As far as petitioner namely, Pradeep Kumar is concerned, it has been submitted that his name has been surfaced in the confessional statement of Sarita Devi. It has also been submitted that Sarita Devi has been granted bail by Co-ordinate

Patna High Court CR. MISC. No.45523 of 2025(3) dt.16-09-2025 3/3 Bench of this Court in Cr. Misc. No. 41161 of 2025. It has been submitted that the case of Pradeep Kumar stands on similar footing that of Sarita Devi. He further submits that a statement has been made in para 3 of the petition that petitioner no. 1 namely, Mohan @ Mohan Lal have no criminal antecedent whereas petitioner namely, Pradeep Kumar has criminal antecedent of one case. Moreover, the petitioners are languishing in judicial custody since 15.05.2025.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners namely, Mohan @ Mohan Lal and Pradeep Kumar are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Sonhan P.S. Case No. 49 of 2025.
