The petitioners apprehend their arrest in connection with Nauhatta P. S. Case No. 12 of 2017 instituted under Sections 147, 148, 149, 308, 323, 324, 341, 354, 379, 459, 504 and 506 of the Indian Penal Code.

The allegation, in brief, is that due to quarrel between the children of both sides, accused persons assaulted the informant side though the specific allegation of assault is against Md. Kadir who is said to have given Farsa blow over the head of the informant.

Learned counsel for the petitioners submits that there is no any specific allegation of assault against these two

Having considered the aforesaid facts and circumstances, let the petitioners, namely, Md. Samid and Md. Nizam, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Nauhatta P.S.Case No. 12 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
