The petitioner apprehends his arrest in connection with Sare P.S. Case No. 04 of 2020 registered under Sections 147, 148, 323, 504, 354 and 354A of the Indian Penal Code and under Sections 8/12 of the POCSO Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that in the instant case, the first information report is lodged after three days of the alleged occurrence. There is case and counter case between the parties, as detailed in Annexure nos. 1 and 2. Further submission is that uncle of the petitioner has also filed an informatory petition (Annexure-3) before the learned C.J.M.,
Patna High Court CR. MISC. No.3598 of 2021(2) dt.22-09-2021 2/2 Nalanda against the informant of the present case stating therein that there is land dispute in between the parties and the informant has lodged a false case. Petitioner has got no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the C.J.M. Nalanda in connection with Sare P.S. Case No. 04 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C. shailendra/- (Arvind Srivastava, J) U T
