2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 334 (1) and 305 of the BNS.
3. The case of the prosecution is that unknown miscreants committed theft in the shop of the informant and took away a sum of Rs. 15 lakhs with certain documents.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the FIR has been lodged against unknown miscreants. During the course of investigation, Md. Imitiyaz has given his confessional statement but nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has been implicated in this case on account of his past
Patna High Court CR. MISC. No.46372 of 2025(3) dt.16-09-2025 2/2 antecedents. It is further submitted that co-accused Sahid Ahmad @ Pappu @ Kana @ Md. Sahid Ahmad @ Pappu Kana and Md. Sikandar against whom similar allegations have been leveled, have already been granted bail vide order dated 26.05.2025 & 25.07.2025 passed in Cr. Misc. Nos 34918 of 2025 & 48748 of 2025 respectively. It is further contended that the case of this petitioner stands on identical footing. Moreover, the petitioner is languishing in judicial custody since 22.01.2025.
5. Learned APP for the State, however, opposed the prayer for bail submitting that the petitioner has criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kotwali P.S. Case No. 617 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya.
