Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending their arrest in connection with Chiraiya P.S. Case No. 421 of 2019 for the offence registered under Sections 341, 323, 353, 504, 506 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners have falsely been implicated in connection with the present case. It is further submitted that there is general and
Patna High Court CR. MISC. No.5555 of 2021(2) dt.25-11-2021 2/2 omnibus allegation against the petitioners. There is no cogent evidence against the petitioners. It is further submitted that the alleged occurrence took place on 18.08.2019 and the first information report has been lodged after delay of two days on 20.08.2019. It is further submitted that all the sections are bailable except Section 353 of the Indian Penal Code and the petitioners have got clean and fair antecedents. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-4, East Champaran at Dhaka in connection with Chiraiya P.S. Case No. 421 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
