The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 166, 167, 420, 466, 467, 468, 471, 472, 473, 474, 477, 504, 120(B), 34 of the Indian Penal Code. It is alleged that this petitioner fraudulently got the land of the informant executed in her favour. It is submitted by learned counsel for the petitioner that petitioner is innocent and she has not
Patna High Court CR. MISC. No.46860 of 2022(2) dt.14-09-2022 2/3 committed any offence. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. It is further submitted that petitioner has purchased the said land from late Nand Kishore Prasad and he has filed a probate case in the Court below, which was converted into a title suit and the said decree was passed in favour of Nand Kishore Prasad against which a vendor of the informant has filed an appeal in the High Court, which is pending till date. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case
