The petitioner apprehends his arrest in connection with Ladaniya P.S. Case No. 39 of 2018, C.R.I. No. 403 of 2018 for the offences punishable under Sections 341, 323, 504, 498 (A) of the Indian Penal Code and Section 3/ 4 Dowry Act. Petitioner, who happens to be husband of the informant along with his family member is said to have demanded rupees two lacs as dowry and tormented her and finally drove her out of her marital house over demand. Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. Petitioner has been falsely implicated in the aforesaid case. Petitioner is quite

No.67058 of 2018(5) dt.06-05-2019 2/3 innocent and he has neither made any dowry demand nor subjected the informant to any sort of torture nor drove her out of her marital house. It is further submitted by the learned counsel for the petitioner that due to some mental trouble O.P. No.2 used to flee away from the marital house. Petitioner is ready to keep the informant with him with full honour and dignity and provide adequate medical aid to get cure her ailment. O.P. No.2 had put her appearance in the Court and on the consent of both parties the matter was referred to the High Court, Mediation Center to explore the possibilities of reconciliation between them fixing 09.01.2019 for their appearance before the Mediator, but O.P. No.2 did not turn up either on 09.01.2019 or on giving notice by the Mediator resultantly the mediation stood failed.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.IV Madhubani in connection with Ladaniya P.S. Case No. 39 of 2018, subject to the condition as laid down under Section 438
