2. The petitioner apprehends his arrest for the offences alleged under Sections 419 and 420 of the Indian Penal Code and Section 10 of Bihar Conduct of Examination Act, 1981 registered in connection with Danapur P.S. Case No. 138 of 2018.
3. It is submitted that the petitioner has been falsely implicated and he has not induced any person to appear in his place in the examination. As a matter of fact, the petitioner could not appear in the examination owing to illness and remained at home.
4. Having regard to the nature of accusation and gravity of the offence alleged and also considering that the petitioner was the ultimate beneficiary of his impersonation by
Patna High Court Cr.Misc. No.65968 of 2018(3) dt.05-02-2019 2/2 co-accused Sonu Kumar, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The anticipatory bail petition stands dismissed. It is made clear that if the petitioner surrenders and seeks for regular bail before the Court below, the same shall be considered and disposed of expeditiously on its own merits .
