In pursuance to the direction of this Court, a report with regard to the present stage of trial has been received which is annexed with the case diary.

The report of learned 1st Additional District and Sessions Judge-cum-Special Judge, SC/ST(POA) Act, Sitamarhi dated 06.12.2023 suggests that trial shall be concluded within period of 03 months.

In that view of the matter, learned counsel for the appellant seeks permission to withdraw the appeal after

Patna High Court CR. APP (SJ) No.3259 of 2023(5) dt.04-01-2024 2/2 making some submission.

Permission is accorded.

Accordingly, the appeal is dismissed as withdrawn.

The learned trial court is directed to conclude the trial within the stipulated period as mentioned in the above report failing which, the appellant will be at liberty to renew his prayer for bail.
