2. The petitioner has preferred this application for grant of regular bail in connection with Sugauli P.S. Case No. 442 of 2024 dated 09.10.2024 registered for the offences punishable under Sections 103(1) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, it is alleged that the informant had borrowed Rs. 1,50,000/- from the petitioner. Thereafter, the accused persons started putting pressure on the informant to return his money and thereafter, the petitioner and the co-accused persons asked the informant to register his land in their favour, but wife of the informant did not agree with the

On 09.10.2024, the petitioner and the co-accused persons brought the informant to Registry Office, Motihari for registry of land, in the meantime, the informant went to attend the call of nature. When, the accused persons did not find the informant in Registry Office, they made telephonic call to co-accused Heeralal Yadav and his wife to find out the informant from his house. Thereafter, the co-accused persons went to the house of the informant and started abusing and committed murder of the wife of the informant by pressing her neck.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has transpired in this case during the course of investigation. There is no specific allegation against the petitioner rather the specific allegation of committing murder is against the co-accused, Heeralal Yadav and his wife. It is further submitted that the petitioner was not present at the time of alleged occurrence and he has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.04.2025.

5. Learned A.P.P. for the State has opposed the bail

Patna High Court CR. MISC. No.44951 of 2025(2) dt.05-08-2025 3/3 petition of the petitioner and submitted that as per para-37 of the case diary, mentioned in the impugned order dated 19.05.2025, the cause of death is asphyxia due to hanging, caused by ligature.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Sugauli P.S. Case No. 442 of 2024.

7. The application stands allowed.
