JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-12-2019 Having sensed the difficulty in persuading this Court to grant anticipatory bail to the appellant, who is an accused of serious offence and since 2016 he has not surrendered, learned counsel for the appellant seeks permission to withdraw this appeal. Learned counsel submits that in such circumstance the appellant shall surrender and seek regular bail on its own merit. The appeal is, thus, dismissed as withdrawn. In case the appellant surrenders and prays for regular bail in the court below, the same will be considered in accordance with law on the basis of the materials on record.
