The petitioner seeks pre-arrest bail in connection with Gopalganj Manjhagarh P.S. Case No.40 of 2018 registered for the offence punishable under Sections 304B, 302 and 120B read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the case of the petitioner stands on identical footing to that of Most. Ramgati Devi @ Ramjati Devi, Birendra Prasad @ Birendra Mahto, Rita Devi, who had already been granted bail vide order dated 19.07.2018 passed in Cr. Misc. No.34649 of 2018 as contained in Annexure-4 to this petition by a Bench of this Court.

The said submission made by the learned counsel for

Patna High Court Cr.Misc. No.61188 of 2018(4) dt.12-12-2018 2/2 the petitioner has not been controverted by the learned counsel for the State.

In that view of the matter, in the event of arrest or surrender in the court below within a period of six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Manjhagarh P.S. Case No.40 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
