JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 The petitioner has renewed his prayer for bail in a case initially registered under Section 365 of the I.P.C. Subsequently Sections 364, 120B, 201 of the I.P.C was also added.
The petitioner is languishing in custody since 05.08.2013.
It is alleged that father of the informant went missing on 18.07.2013. Subsequently the informant went to the house of the husband of the panchayat Mukhiya and came to know that father of the informant took break fast on the roof of one Subhash Thakur and thereafter he went in the company of the petitioner. Subsequently some witnesses lastly saw the victim in the company of the petitioner. The petitioner also confessed his guilt to have killed the victim by administering huge quantity of liquor and subsequently threw the dead body

It is submitted by learned counsel for the petitioner that except confession before the police and the evidence of last seen there is nothing against the petitioner when similarly situated co-accused on whose roof the victim was last seen has been granted bail vide Cr. Misc. No. 44010 of 2013. Moreover there is no likelihood of trial being concluded in near future.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional District & Sessions Judge, Naugachia in connection with Naugachia P.S. Case No. 176 of 2013, Sessions Trial No. 1131 of 2013.
