JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-06-2021 The petitioner in the present case is seeking regular bail in connection with Amarpur P.S. Case No. 547 of 2018 registered for the offences punishable under Sections 364(4)/120(B)/84 IPC.

From the report as contained in letter no. 29/2021 dated 22.04.2021 received from the court of learned Additional and Sessions Judge II, Banka, it appears that altogether 7 witnesses out of 8 in the chargesheet have been examined so far. Learned A.P.P. for the State submits that since the trial is likely to be concluded within a period of three months post restoration of normalcy due to covid pandemic, the present application may be disposed of with appropriate direction to the learned trial court.

No.3597 of 2021(3) dt.16-06-2021 2/2 In the aforesaid view of the matter, since the trial is at the fag end and the trial court is itself expecting to conclude the trial within a period of three months on start of normal functioning of the court, this Court is not inclined to release the petitioner on bail at this stage, particularly considering his huge criminal antecedents and the other materials which have been noticed in the impugned order.

The learned trial court is expected to conclude the trial within three months after normal functioning of the court starts. If the trial is not concluded within a period of three months, it will be open for the petitioner to approach this Court for an appropriate order.
