The learned counsel for the petitioners submits that the learned Court below after hearing the counsel for the petitioners was pleased to grant anticipatory bail till filing of the charge-sheet. It is submitted that the Court prima facie was convinced in the nature of allegation that it was a case for grant of bail, but jurisdiction exercised was only uptil filing of chargesheet. The learned counsel for the petitioners next submits that petitioner no.1 is a senior citizen aged about 71 years. The learned counsel thus submits that since the

Patna High Court CR. MISC. No.57354 of 2021(2) dt.07-07-2022 2/2 learned Court below by order dated 15.06.2019 was pleased to grant anticipatory bail, as such, the present anticipatory bail application is not being pressed and thus, seeks permission to withdraw the case.

Permission is accorded with a direction to the learned Court below, if possible, to consider the anticipatory bail application of the petitioners on the same day, if they surrender in between 11.07.2022 to 20.07.2022. The learned Court below shall also keep in mind that petitioner no.1 is a senior citizen aged about 71 years.
