Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(A) of the Bihar Prohibition & Excise Act, 2016. There is recovery of 51.840 litres of foreign liquor from a car which belongs to the petitioner.
Patna High Court CR. MISC. No.3394 of 2021(2) dt.16-11-2021 2/2 Considering the fact that the alleged foreign liquor was seized from the car of the petitioner, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.
The Court below is directed to consider the prayer for bail of the petitioner without being prejudiced by the order of this Court, if the petitioner surrenders within a period of six weeks and pray for regular bail. With the aforesaid observation/direction, the application stands disposed off.
