JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-01-2020 This writ application has been filed seeking quashing of orders of the Managing Director, Bihar State Cooperative Marketing Union Limited (BISCOMAUN) dated 01.07.2009 issued vide Memo No. 213 and 16.07.2009 issued vide Memo No. 215 whereby the petitioner's services have been terminated. A counter affidavit has been filed on behalf of BISCOMAUN stating therein that for the same cause of action and seeking same relief the petitioner had earlier approached this Court by filing CWJC No. 4103 of 2010, which was allowed to be withdrawn with a liberty to approach alternative
Patna High Court CWJC No.582 of 2012(2) dt.22-01-2020 2/2 forum including the Registrar, Cooperative Societies, Bihar. The petitioner has apparently not approached the Registrar, Cooperative Societies or any other authority despite liberty having been granted by this Court in the order dated 22.03.2010. It is accordingly the stand of the BISCOMAUN that this application is not maintainable.
I find force in submission made on behalf of the BISCOMAUN. There is no denial of the averments made in the counter affidavit. This application is accordingly dismissed. (Chakradhari Sharan Singh, J) Rajesh/- U
