JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This application, for grant of anticipatory bail, arises out of Birupur P.S. Case No. 27 of 2019, disclosing offences under Section 7 of the Essential Commodities Act. Allegation is of recovery of 54 bags of rice each containing 50 K.G. total 27 quintal rice was recovered and two persons were apprehended, who disclosed that they have purchased the same from the PDS shop of petitioner. Submission of learned counsel for the petitioner is that his shop was inspected an only 8 bags of rice and 2 bags of wheat was found sort. Furthermore, only on the basis of disclosure made by the co-accused persons, the petitioner has been made accused in this case.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Birupur P.S. Case No. 27 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
