The petitioner apprehends his arrest in connection with Gaurichak P. S. Case No. 242 of 2016 instituted under Sections 379, 411, 413 and 414/34 of the Indian Penal Code. The allegation, in brief, is that one stolen motorcycle was recovered from in front of the house of the petitioner after confessional statement of another co-accused Sonu Kumar. Learned counsel for the petitioner submits that seizure list is of dated 20.10.2016 while the FIR was lodged on the next day of the seizure list. Further submission is that recovery of motorcycle is not from the conscious possession of the petitioner and except that there is no any material against this petitioner and he has clean antecedent.

No.39279 of 2017 (2) dt.19-08-2017 2/2 Having considered the aforesaid facts and circumstances, let the petitioner, namely, Anil Das in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna City in connection with Gaurichak P.S.Case No. 242 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
