The petitioner apprehends his arrest in connection with Warisnagar P. S. Case No. 60 of 2017 instituted under Sections 307, 323, 341 and 506/34 of the Indian Penal Code. The allegation, in brief, is that accused persons intercepted the informant's husband on the way and assaulted him along with his elder brother, then they also assaulted brother of informant's husband with Farsa.
Learned counsel for the petitioner submits that petitioner and the informant are residing in the same vicinity and there was some dispute relating to payment of arrear by the informant's side and there is no injury to the informant's husband and injury sustained by the brother of the husband of the informant
Patna High Court Cr.Misc. No.37503 of 2017 (2) dt.10-08-2017 2/2 is simple in nature and there is also no specific allegation of causing injury and this petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Dipu Kumar @ Dipu Kuwar @ Dipu Kumar, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with P.S.Case No. 60 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
