Mr.Shailendra Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-08-2019 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307 and 325/34 of the Indian Penal Code. The prosecution case is that on 26.05.2019 while the informant Santwant Kumar was going to his house by a motorcycle when co-villagers and the petitioners dashed him. On protest being made, they assaulted the informant with an iron rod.

It is submitted by learned counsel for the petitioners that due to old enmity, the accusation has been levelled and the

It is further submitted that there is a counter version of the occurrence being Jamhore P.S. Case No. 64 of 2019 and for the occurrence of 26.05.2019 the FIR was registered on 27.05.2019 at 7.15 P.M. Though, the petitioners are accused in one another case of trivial nature.

Learned APP submits that the petitioners are named in the FIR.

Considering the simple nature of injury caused and there being counter version of the occurrence also, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Jamhore P.S. Case No. 63 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
