The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 379/34 and 395 of the Indian Penal Code.

The informant claims to be a businessman of jewellery. On the alleged night of occurrence, he was going to railway station to get a train for his journey. On the way, a four wheeler stopped. Two persons, from the four wheeler, came down and they posed themselves as policemen, threatened the informant to be indulged in illegal activity. Thereafter, snatched gold etc. of the informant, except some personal belongings and asked the informant to wait there when the police would come and inquire from him. Thereafter, they fled away. The FIR was lodged against unknown. During investigation, three persons were arrested and have confessed before the police. Name of the petitioner

Patna High Court Cr.Misc. No.60207 of 2018 (3) dt.05-11-2018 2/2 surfaced in the confessional statement of co-accused Md. Sahjad. Submission of learned counsel for the petitioner is that the petitioner is Secretary of the Police Men's Association and was never posted in any police station at Patna, rather he was posted at the police line. He is ready to cooperate with the investigation even to appear for identification by the informant, if directed. After hearing the parties and considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.

20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Kadamkuan Police Station Case No. 402 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
