The petitioner seeks bail in a case registered for the offence punishable under Sections 376 (AB) of the Indian Penal Code and Sections 4, 6 and 8 of the POCSO Act. In pursuance to the order dated 18.03.2021, status report of trial in connection with Siwan (Mahila) P.S. Case No. 40 of 2019 giving rise to T.R. No. 153 of 2019 has been received and kept at Flag-A, in which it is stated that this case is now at the stage of evidence of the prosecution, seven prosecution witnesses out of nine charge sheeted witnesses have been examined and two months time is sufficient for conclusion of the trial.
Considering the present stage of trial, I am not
Patna High Court CR. MISC. No.3783 of 2021(4) dt.15-07-2021 2/2 inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Siwan (Mahila) P.S. Case No. 40 of 2019, giving rise to Tr. No. 153 of 2019 pending before the court of the learned Special Judge, POCSO, Siwan. Accordingly, the application is dismissed.
