The petitioner apprehends his arrest in connection with Laxmipur (Didhour) P.S. Case No. 47 of 2016, registered for the offences punishable under Sections 304, 201/34 of the Indian Penal Code.
Allegedly, on account of land dispute, an altercation took place between the husband and the father-in-law of the informant and on account of that, the father-in-law of the informant with other accused persons caught hold the husband of the informant and all of them, after tying hands and legs of the deceased, hanged him as a result of which, he died. Submission is of false implication and that due to land dispute the petitioner and others have been implicated, the
Patna High Court Cr.Misc. No.46307 of 2017 (2) dt.17-10-2017 2/2 prosecution story appears not probable and reliable, after competing investigation chargesheet has been submitted under Section 304, 201/34 of the I.P.C. In this case Manti Devi and Renu Devi have been allowed pre-arrest bail vide Cr. Misc. No. 54645 of 2016 and thereafter Upendra Yadav and Dokal Yadav @ Dhokal Yadav have also been allowed pre-arrest bail vide Cr. Misc. No. 26655 of 2017 by another co-ordinate benches of this Court and, as such, the petitioner deserves sympathetic consideration.
The learned A.P.P. fairly submits that other coaccused have been allowed bail. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, J.M. 1st Class, Jamui, in connection with Laxmipur (Gidhour) P.S. Case No. 47 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
